This article, published by the Society for Human Resource Management (SHRM) indicates a growing trend towards workplace wellness programs designed to "get control" over the increasing health care costs associated with unhealthy employee behaviour (i.e. smoking and/ or poor eating habits) that lead to illness and costly, chronic health conditions.

But authors and legal experts Francis P. Alvarez and Michael J. Soltis warn that while workplace wellness programs may be an attractive way to cut costs, "they raise a variety of legal issues that human resource professionals must consider before they implement wellness efforts in their organizations".

The article goes on to detail potential conflicts for American firms under U.S. law including the Employee Retirement Income Security Act (ERISA) and the Americans with Disabilities Act (ADA).

While the authors to not dissuade management from implementing workplace wellness programs, they do encourage thoughtful consideration of any potential legal risks and careful follow-up monitoring.
